All GURHAN product will be delivered with retail price tags, unless directed otherwise before shipping.
Prices will be quoted at MSRP. Gold is at keystone (x 2 wholesale) and Silver retail is at 2.2 x wholesale.
Discounting of GURHAN product is permitted only with prior written approval.
SPECIAL ORDER PRICING
Please call to confirm prices before quoting a Special Order. Prices for Special Orders or any non-standard styles are valid for 30 days only. Prices are subject to change without prior notification. All price changes will be posted on OPT.
Customers carrying consignment are required to re-price all merchandise and will be invoiced at the new prices without exception.
GURHAN will provide new tags at current prices for all owned and consigned merchandise, upon request.
Orders may be placed directly with your Account Executive or our Sales Office. You can submit your order via email, fax, or phone. No orders will be submitted for Production until written Order Confirmation has been received by GURHAN.
After review by GURHAN, you will be emailed an order approval. Please review carefully to ensure accuracy of items ordered, delivery date, terms and conditions. Any changes should be submitted in writing within 2 business days after receipt to ensure the quoted delivery time. If we do not receive a reply within 48 hours, the order is considered approved.
CANCELLATIONS AND CHANGES
Our designs are handmade to order. Cancellations or changes, cannot be accepted after customer confirmation is received. Any changes or cancellations will be subject to an Order Change/Cancellation Charge of 30% of the amount of the order.
All Special Orders are “final sale” and will not be accepted for return. In some cases, prepayment may be required.
Special Orders require approval from our product development team which requires at least two business days to be processed. Upon approval, you will receive a new style number and the appropriate price.
Styles which were formerly in the line but are no longer current may only be processed as special orders . This means that they are final sale and subject to price quote and approval.
SHIPPING AND DELIVERY
A ship date will be indicated on the Order Summary prior to your Order Approval. Our standard delivery time is within 6-8 weeks. GURHAN can make partial shipments or deliver goods in installments, with Customer’s confirmed approval. Additional shipping charges apply for partial shipments requested by Customer.
GURHAN is not responsible for any harm, loss or expense if we fail to meet a specified delivery schedule due to production, shipping, or customs delays or due to any circumstance beyond the reasonable control of GURHAN. When possible we will advise you of delays and request a delivery date extension.
The Customer is responsible for all shipping, handling and insurance costs.
GURHAN strongly encourages all orders to ship via the Customer’s preferred method of shipping using the Customer’s FedEx or UPS account number. In such cases, Customer is solely responsible for insuring the merchandise at wholesale value.
If Customer does not provide their shipping account, GURHAN will ship via insured USPS, UPS or FedEx and Customer will be invoiced and responsible for a flat charge covering shipping, handling and insurance.
Shipping Costs –
$35 on all standard FedEx two day delivery
$50 overnight charge
When returning product to GURHAN, Customer is responsible for all shipping costs and is required to insure all product at full wholesale value. All returns will be processed within 48 hours and customer will be informed of any discrepancies. Customer is fully responsible for any repair charges for damages or discrepancies.
ACCEPTANCE OF PRODUCT
It is the Customer’s responsibility to examine all shipments upon receipt and notify GURHAN within 3 business days with any issues or discrepancies. After that time, it will be assumed that the shipment has been fully accepted.
Non-acceptance is valid only in the circumstance of non-conformity with the original order terms. GURHAN products are hand-made to order. Accordingly, there will always be minor variations from piece to piece. Such variations are inherent and are not grounds for non-acceptance of merchandise.
CURE & REPLACEMENT
GURHAN, at its sole discretion, reserves the right to cure non-conformity by repair, alteration or replacement of the product.
RETURN AUTHORIZATIONS AND PODs
RA NUMBER REQUIRED
All returns of merchandise to GURHAN are subject to the prior approval of GURHAN and the assignment of a Return Authorization Number (RA#) provided by GURHAN.
GURHAN will not accept any unauthorized returns of merchandise. RA#s must be clearly labeled on the outside packaging of all returns and on all enclosed paperwork. Unauthorized returns will be refused and returned to the Sender at the Sender’s expense.
RESPONSIBILITY & PROOF OF DELIVERY
The Sender is fully responsible for shipping and insurance charges.
Customer is responsible for product that is being returned to GURHAN until it is received by GURHAN.
All authorized returns should be sent via a carrier that is trackable and insurable. The Customer is responsible for providing PODs in the event of any dispute regarding receipt.
All product returned to GURHAN must be packed properly in order to avoid loss or damage. Customer is responsible for the condition of the goods when received by GURHAN.
Stock Balancing is at the sole discretion of GURHAN and must be approved by GURHAN in advance. GURHAN may agree to a Stock Balance in conjunction with a stock order placed at the same time. Returns of stock will not be accepted until after replacement goods have been shipped. Under no circumstance may stock be returned in lieu of payment of outstanding invoices.
Not available to past due accounts.
May not include custom or special orders.
May not include any resized or altered stock.
May not include any stock which has been repaired or altered by the Customer.
May not include damaged or shop-worn stock.
Must be made in conjunction with a confirmed stock purchase.
A restocking fee of 5% will apply to the value of the amount of the Stock Balance. The value of the stock being returned will be credited at the original invoice value against the value of the new stock order.
REPAIRS AND ALTERATIONS
All repairs and alterations of GURHAN jewelry must be performed by GURHAN. GURHAN is not responsible for any of its merchandise that has been adjusted, repaired, refinished or altered in any way by anyone except GURHAN. This includes ring sizing. In such cases the warranty is void.
Please contact customer service for an RA#. An RA# is required for all repairs and must be included on the outside packaging and on all enclosed paperwork of repairs or alterations. Please include a clear definition of what alteration is required. GURHAN will advise time and cost estimate for customer approval.
No repair or alteration will be started until the customer acceptance is received by return email.
Only the altered piece of jewelry will be returned. Parts (broken stones, metal, etc.) removed from the jewelry will not be returned.
Standard repair or alteration will be provided within 6-8 weeks. In some cases, due to GURHAN’s techniques, we may need additional time to remake the item. In such cases, GURHAN will advise the expected service time and any charges.
There may be items such as ancient pieces, micro mosaics and various stones that, once broken or damaged, are non-repairable or alterable. In such cases GURHAN will notify the customer.
GURHAN offers a lifetime warranty for defects in manufacturing and materials but not for normal wear and tear. The GURHAN warranty is void if repair work is done by anyone other than GURHAN or if the customer alters the piece in any way.
GURHAN may, within its sole discretion, absorb the cost of any refurbishment for wear and tear depending on its assessment of the nature of the damage.
It is recommended that any strung necklace or bracelet be sent in for rethreading every 1-2 years. GURHAN does not charge for this service.
Customers are responsible for the cost of repairs resulting from damage beyond normal wear and tear. This includes lost parts.
GURHAN may at its discretion, provide merchandise to its customers on a consignment basis for a designated timeframe.
CONTRACT & UCC FILING
Before any account is entitled to receive consignment, GURHAN requires that a consignment agreement be signed by the Customer. All merchandise provided on consignment will be secured by GURHAN pursuant to UCC-1 filings. Customer will bear any fees arising therefrom in their state.
Consignment is not available to past due accounts and will be recalled in the event that a Customer’s account becomes past due.
Title to merchandise is and shall remain GURHAN’s, until paid for. All merchandise provided on a consignment basis - regardless of time frame - is at the complete risk of the consignee. This includes all loss or damage regardless of circumstances.
SALES REPORTING AND INVENTORY RECONCILIATION
By accepting memo merchandise, the customer agrees to provide GURHAN, by the 10th of each month:
A report of all sales from memo in the preceding month
An inventory reconciliation of the remaining merchandise
Payment for all items sold on due terms
All merchandise is subject to immediate recall at the discretion of GURHAN. Return freight, including insurance, is the responsibility of the customer. Within 3 days of a recall, consignment merchandise must be returned to GURHAN or full and immediate payment is due.
TERMS AND PAYMENT
The Customer agrees to honor the payment terms confirmed on the GURHAN Order and Invoice.
Under no circumstance may merchandise be returned in lieu of payment.
With approved credit, terms are Net 30 days from receipt of goods.
Customers requesting Net 30 terms must submit a Credit Application. Opening Orders will not be processed until Credit Application has been received and credit approved.
Visa and MasterCard are accepted. Customers are responsible for credit card fees.
PAST DUE ACCOUNTS
Orders will not be shipped to Customers who are over 30 days past due. In such cases the balance must be paid in full.
No orders will be manufactured for Customers who are over 60 days past due.
Customers who have been over 60 days past due more than once will be placed on Pre-Payment and no orders or repairs will be processed until past due balances have been paid and pre-payment of current order is received.
Customers will be assessed a monthly finance charge of 1.5% on all past due balances. This charge will be calculated monthly by GURHAN and included in our Monthly Statement.
Trunks, Pick Boxes, Stock Balancing are not available for past due accounts.
TRUNK SHOWS AND PERSONAL APPEARANCES
Trunks Shows should be arranged with your Account Executive at least 3 to 6 months in advance to guarantee an available date.
Trunk Shows requests will be considered from Customers that have placed their seasonal stock orders.
Personal Appearances (PAs) will be considered based on sales performance and availability. Our minimum event expectation is $100,000 in retail sales. Any shortfall in sales must be supplemented with a stock purchase for the balance.
GURHAN requires that Customers sign an Event Agreement. This agreement outlines sales and marketing responsibilities.
GURHAN will provide marketing materials and include the confirmed date on our website. All advertisements, digital placements, in-store signage or web materials that display the GURHAN logo or include GURHAN images must receive prior approval by GURHAN Marketing. This includes all material whether or not coop is being applied.
GURHAN will provide a “Menu of Events” for the account to select from, once a date and type of event is approved. This outlines all details and respective financial responsibilities of each approved store event.
Should legal action become necessary to collect past due balances, Customer agrees to pay all costs of collection, including reasonable attorney fees, all interest and all court costs. The contractual relations between GURHAN and the Retail Partner are governed by the laws of New York State. Any dispute arising from this agreement must be resolved within that jurisdiction.
